Please read these Terms of Service (“Terms”) carefully before using the services provided by The Repair Square (“Company,” “we,” “us,” or “our”). By accessing or using our services, products, or website (the “Service”), you agree to be bound by these Terms. If you do not agree to all of these Terms, you should not access or use our Service.
SECTION 1 – ELIGIBILITY AND ACCEPTANCE
1.1 By requesting repair services, booking an appointment, or using this website, you confirm that you are at least 18 years old or have the authority to act on behalf of the device owner.
1.2 You agree that all information you provide to The Repair Square, including contact information, device details, and repair requests, is accurate and complete to the best of your knowledge.
1.3 By submitting a device for repair, booking an appointment, or otherwise using our services, you acknowledge that you have read, understood, and agreed to these Terms & Conditions.
1.4 The customer confirms that they are the legal owner of the device or have permission from the owner to authorize repair services. The Repair Square is not responsible for disputes regarding device ownership.
1.5 The customer agrees that The Repair Square may contact them using the phone number or email provided regarding repair updates, service notifications, appointment confirmations, or warranty matters.
1.6 The customer agrees to provide accurate information regarding the device model, condition, known issues, and prior repair history when requesting service. The Repair Square is not responsible for delays, additional repair costs, or service limitations resulting from inaccurate or incomplete information provided by the customer.
1.7 Customer Authorization and Payment Approval
By submitting a device for repair, approving a repair estimate, scheduling an appointment, or making payment, the customer confirms that they authorize The Repair Square to perform the requested services and charge the agreed repair fees. This authorization applies to in-store, online, phone, or text message approvals.
SECTION 2 – WEBSITE AND SERVICE USE
2.1 The Repair Square reserves the right to refuse service, cancel, decline, or reschedule appointments, or limit access to its website or services at its sole discretion, including in cases of misuse, abuse, suspected fraud, or violation of these Terms.
2.2 You agree not to misuse this website, interfere with its functionality, attempt unauthorized access to company systems, or use the website for unlawful purposes.
2.3 Any appointment requests, contact submissions, or other communications made through this website do not guarantee service availability, repair completion time, or repair outcome.
2.4 Submitting an appointment request through the website does not guarantee repair availability, parts availability, or same-day service.
2.5 The Repair Square may use third-party tools or services (including booking platforms, payment processors, or communication systems) to provide its services. The Company is not responsible for interruptions or errors caused by such third-party systems.
2.6 Customers are responsible for responding to communication from The Repair Square regarding repair approvals, updates, or device pickup. Failure to respond in a timely manner may delay repair completion or service processing.
SECTION 3 – ACCURACY OF INFORMATION
3.1 The Repair Square makes reasonable efforts to keep information on its website, including service descriptions, pricing references, store hours, and contact information, accurate and up to date.
3.2 However, all website content is provided for general informational purposes only and may be changed, updated, or removed at any time without notice.
3.3 The Repair Square does not guarantee that all information on the website is free from errors, omissions, or inaccuracies, and customers are encouraged to contact the store directly to confirm current service availability, pricing, and repair details.
3.4 Any pricing references displayed on the website are estimates only and may vary depending on device model, condition, diagnostic results, and parts availability.
SECTION 4 – SERVICE AND PRICE MODIFICATIONS
4.1 Prices, service availability, repair estimates, and product specifications are subject to change without prior notice.
4.2 The Repair Square reserves the right to modify, suspend, or discontinue any service, repair offering, or product at any time without liability.
4.3 Repair estimates provided prior to service are based on the information available at the time of evaluation. Additional issues may be discovered during the diagnostic or repair process that could affect the final repair cost. Customers will be notified for approval before any additional repairs are performed.
4.4 Repair completion times and pricing may vary depending on parts availability, device model, and supplier conditions. The Repair Square is not responsible for delays caused by parts shortages, shipping delays, or manufacturer limitations.
SECTION 5 – PRODUCTS AND SERVICES
5.1 Certain products or services may be available exclusively online with quantities limited. We reserve the right to limit purchases and cancel orders at our discretion.
5.2 Product images and descriptions are for illustrative purposes only; actual products may differ in color, size, or appearance.
5.3 Repair outcomes may vary depending on device condition, prior damage, or internal component issues. The Repair Square does not guarantee that every device can be fully restored to its original condition.
5.4 We disclaim all warranties, express or implied, including merchantability and fitness for a particular purpose, except where prohibited by law.
5.5 Replacement parts used in repairs may include new, refurbished, aftermarket, or OEM-compatible components depending on availability and the repair option selected by the customer. The Repair Square does not guarantee that replacement parts will be manufactured by the original device manufacturer unless specifically stated.
5.6 Pre-owned or refurbished devices sold by The Repair Square may show minor cosmetic wear consistent with normal use. All devices are tested for basic functionality prior to sale, but cosmetic condition may vary.
5.7 Accessories sold by The Repair Square, including but not limited to chargers, cables, cases, and screen protectors, may be manufactured by third-party brands. Compatibility and performance may vary depending on the device model.
5.8 Devices submitted for repair may have pre-existing damage or internal component failures that are not visible during initial inspection. The Repair Square is not responsible for issues that arise due to the device's prior condition.
SECTION 6 – BILLING, PAYMENT, AND ACCOUNT INFORMATION
6.1 By submitting an order, you represent that you are authorized to use the payment method provided.
6.2 We reserve the right to refuse or cancel any order for reasons including but not limited to product availability, errors in pricing or description, or suspicion of fraudulent activity.
6.3 You agree to promptly update your account information, including payment details, to keep it accurate and complete.
6.4 Diagnostic or labor fees may apply even if the customer chooses not to proceed with the recommended repair. These fees compensate for technician time and device inspection.
6.5 Devices not picked up within 30 days after repair completion or notification may be considered abandoned. The Repair Square reserves the right to recycle, dispose of, or sell abandoned devices to recover repair or storage costs where permitted by law.
SECTION 7 – REPAIR WARRANTY AND LIMITATION OF LIABILITY
7.1 Service Agreement and Fees
The Repair Square (hereinafter referred to as “the Company”) agrees to perform repair services strictly as outlined in the Work Authorization Agreement executed by the customer. The Company shall charge the fees set forth in the Work Authorization Agreement, which fees are exclusive of any applicable taxes, duties, or governmental charges, all of which shall be the responsibility of the customer.
7.2 Customer Data Responsibility
The customer acknowledges and agrees that it is solely their responsibility to back up all data, content, and information stored on the device prior to submitting the device for repair. The Company expressly disclaims any liability for loss, corruption, or damage to data, software, or device functionality that may occur during or after the repair process.
7.3 Warranty Period and Scope
The Company provides a limited warranty on repairs as follows:
Premium Quality iPhone Screens: One (1) year limited warranty covering defects in materials and workmanship under normal use.
Generic/OEM Quality iPhone Screens: Ninety (90) days limited warranty under the same conditions.
All other repairs: Ninety (90) days limited warranty unless otherwise specified in writing.
7.4 Warranty Claims and Return of Device
To submit a warranty claim, the customer must return the repaired device to the original service location at their own expense. The Company reserves the right to inspect the device to determine the validity of the warranty claim prior to any repair, replacement, or refund.
7.5 Warranty Exclusions
The limited warranty shall not apply, and the Company shall have no liability, under the following conditions:
•Damage caused by accidents, misuse, abuse, neglect, or unauthorized alterations or modifications.
•Damage caused by exposure to water, liquids, or other environmental conditions unless expressly covered by a separate warranty or service agreement.
•Damage or malfunctions resulting from third-party products, accessories, software, or services not provided or authorized by the Company.
•Repairs or services performed by any party other than the Company following the original repair service.
•Software issues, including but not limited to malfunctions, data loss, or compatibility issues.
•Devices that are lost, stolen, or otherwise irreparably damaged.
7.6 Limitation of Liability
Except for the limited warranty explicitly stated herein, the Company shall not be liable for any indirect, incidental, consequential, or punitive damages arising out of or related to the repair services or use of the device after repair, including but not limited to loss of profits, business interruption, or data loss.
7.7 Disclaimer of Implied Warranties
Except for the express warranties stated in this section, the Company disclaims all other warranties, express or implied, including but not limited to any implied warranties of merchantability or fitness for a particular purpose.
7.8 Customer’s Obligation to Inspect
The customer agrees to inspect the device promptly upon receipt of repair services and notify the Company of any issues or defects covered under warranty. Failure to provide timely notice may result in denial of warranty service.
7.9 Use of Replacement Parts
The Company reserves the right to use new, refurbished, or OEM parts for repair services. Any parts replaced during the repair become the property of the Company unless otherwise agreed in writing.
7.10 No Guarantee of Device Functionality Post-Repair
The Company does not guarantee that all device functionality can be fully restored, particularly where underlying damage or component failure exists.
7.11 Governing Law and Dispute Resolution
Any disputes arising under this agreement shall be governed by the laws of New Jersey, and the parties agree to submit to the exclusive jurisdiction of the courts located in New Jersey.
7.12 Repair Time Estimates
Repair timeframes provided are estimates only and may be subject to change based on parts availability or unforeseen issues. The Company is not liable for delays in repair completion.
7.13 Customer Property
Any personal property (e.g., memory cards, SIM cards, accessories) left in or on the device during repair is left at the customer’s own risk. The Company is not responsible for loss or damage to such items.
7.14 Data Privacy and Security
The Company will take reasonable precautions to protect customer data but is not liable for any breach, loss, or unauthorized access during the repair process.
7.15 Payment Terms
Full payment is required upon completion of repair services unless otherwise agreed in writing. The Company reserves the right to retain possession of the device until payment is received.
7.16 Cancellation and No-Show Policy
Customers must notify the Company at least [e.g., 24 hours] in advance to cancel or reschedule appointments. Failure to do so may result in cancellation fees or forfeiture of deposits.
7.17 Indemnification
Customer agrees to indemnify and hold harmless the Company, its employees, and agents from any claims, damages, or liabilities arising out of customer’s negligence, misuse, or failure to follow instructions.
7.18 Salvage of Irreparable Devices
If a device is deemed irreparable, the Company may offer to return the device for salvage or dispose of it at the customer’s discretion. The Company is not responsible for any lost data or device value in such cases.
7.19 Pre-Existing Device Conditions
Devices submitted for repair may have pre-existing damage, wear, or internal component failures that may not be visible during initial inspection. The Repair Square is not responsible for issues that arise as a result of the device’s prior condition, including but not limited to internal damage, corrosion, or component failure discovered during or after the repair process.
7.20 Risk of Additional Damage During Repair
The Repair Square shall not be responsible for damage that occurs as a result of previously weakened components, prior repairs, manufacturing defects, or overall device condition.
7.21 Water or Liquid Damaged Devices
Devices that have been exposed to water or liquid may have hidden corrosion or internal damage that cannot be fully detected prior to repair. The Repair Square does not guarantee the long-term functionality of devices previously affected by liquid damage.
7.22 Devices not collected within 30 days after notification of repair completion may be considered abandoned. The Company reserves the right to recycle, dispose of, or sell such devices to recover repair or storage costs where permitted by law. The Repair Square may charge reasonable storage fees for devices left beyond the pickup period where permitted by law.
7.23 Locked Devices and Passcodes
Customers may be asked to provide device passcodes, unlock credentials, or disable security features if required to complete diagnostics or repairs. The Repair Square is not responsible for delays or incomplete repairs if the customer declines to provide necessary access to the device.
7.24 Diagnostic Limitations
During the repair or diagnostic process, additional issues may be discovered that were not visible during the initial inspection. The Repair Square reserves the right to notify the customer of any newly discovered issues and obtain approval before proceeding with additional repairs. The Repair Square is not responsible for pre-existing issues that were not detectable prior to the repair process.
7.25 Device Functionality After Repair
Due to the complex and delicate nature of electronic devices, The Repair Square does not guarantee that all device functions will operate exactly as they did prior to damage or repair. Certain features, including but not limited to biometric sensors, cameras, wireless connectivity, or internal components, may be affected by prior damage or manufacturer design limitations.
7.26 Protective Films and Screen Protectors
Screen protectors, protective films, or cases may need to be removed during the repair process. The Repair Square is not responsible for damage to or replacement of these items unless otherwise agreed.
7.25 Pre-Existing and Latent Defects
Electronic devices may contain hidden defects, prior damage, or component failures that are not visible during initial inspection. The Repair Square is not responsible for issues that arise as a result of pre-existing conditions, prior repairs, liquid exposure, or latent defects that become apparent during or after the repair process.
SECTION 8 – THIRD-PARTY LINKS AND SERVICES
8.1 Our Service may contain links to third-party websites or services that are not owned or controlled by the Company.
8.2 We are not responsible for the content, privacy policies, or practices of any third parties and disclaim all liability related thereto.
8.3 You access third-party links at your own risk and should review their terms and policies.
SECTION 9 – USER CONTENT AND FEEDBACK
9.1 By submitting any comments, feedback, or materials to the Company, you grant us a worldwide, royalty-free, perpetual, irrevocable license to use, reproduce, modify, publish, translate, distribute, and display such content in any media.
9.2 You represent and warrant that your submissions do not violate any third-party rights or contain unlawful, defamatory, offensive, or infringing material.
9.3 We reserve the right, but are not obligated, to monitor, edit, or remove user content for any reason.
SECTION 10 – PRIVACY
10.1 Collection and use of personal information are governed by our Privacy Policy, which is incorporated herein by reference.
10.2 By using the Service, you consent to the collection, use, and disclosure of your information as described in the Privacy Policy.
SECTION 11 – ERRORS, OMISSIONS, AND CANCELLATIONS
11.1 We reserve the right to correct any errors or omissions and to cancel, refuse, or modify orders or services in the event of inaccuracies in pricing, repair estimates, product descriptions, or other information.
11.2 We are not liable for any damages or losses resulting from such errors or cancellations.
SECTION 12 – PROHIBITED USES
12.1 You agree not to use the Service to:
•Violate any applicable laws, statutes, or regulations.
•Transmit any viruses, malware, or harmful code.
•Engage in harassment, spamming, or abusive behavior.
•Infringe on intellectual property or other proprietary rights.
12.2 Violation of these prohibitions may result in immediate termination of access and legal action.
SECTION 13 – DISCLAIMERS AND LIABILITY LIMITATIONS
13.1 The services, repairs, and products are provided "as is" and "as available" without warranties of any kind, express or implied.
13.2 The Company disclaims all warranties including but not limited to merchantability, fitness for a particular purpose, and non-infringement.
13.3 To the maximum extent permitted by law, the Company shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising out of your use of the service or products.
13.4 Some jurisdictions do not allow the exclusion or limitation of liability for consequential or incidental damages, so the above limitations may not apply to you.
13.5 Maximum Liability
To the maximum extent permitted by law, the total liability of The Repair Square for any claim arising out of or related to the services, repairs, products, or use of the website shall not exceed the amount paid by the customer for the specific repair or product giving rise to the claim.
13.6 No Guarantee of Continuous Service
The Company does not guarantee that its website, online services, or appointment systems will be uninterrupted, secure, or error-free.
SECTION 14 – INDEMNIFICATION
14.1 You agree to indemnify, defend, and hold harmless the Company, its officers, directors, employees, agents, and affiliates from and against all claims, liabilities, damages, losses, costs, and expenses (including reasonable attorneys’ fees) arising out of or related to your violation of these Terms or your infringement of any rights of a third party.
SECTION 15 - SEVERABILITY
15.1 If any provision of these Terms is held to be invalid, illegal, or unenforceable, the remaining provisions will continue in full force and effect.
SECTION 16 - TERMINATION
16.1 We may terminate or suspend your access to the Service at any time without prior notice or liability if you breach these Terms or for any other reason.
16.2 Upon termination, all rights granted to you will immediately cease.
SECTION 17 - ENTIRE AGREEMENT
17.1 These Terms, together with our Privacy Policy and any other legal notices published by the Company, constitute the entire agreement between you and The Repair Square regarding the Service and supersede any prior agreements.
SECTION 18 – GOVERNING LAW AND JURISDICTION
18.1 These Terms shall be governed by and construed in accordance with the laws of the State of New Jersey, United States, without regard to conflict of law principles.
18.2 You agree to submit to the exclusive jurisdiction of the courts located within the State of New Jersey for any disputes arising under these Terms.
SECTION 19 - CHANGES TO TERMS
19.1 We reserve the right to revise these Terms at any time by updating this page. Changes will take effect immediately upon posting.
19.2 It is your responsibility to review these Terms periodically.
